This section spotlights posts about the photo radar vans not being in compliance with ORS (Oregon Revised Statutes). We will document times when the vans out of compliance and put the information here for all to view. Hopefully documenting these instances will invalidate the tickets, or at least give someone a chance to dispute the ticket. If you see an instance that the van may be out of compliance, take some photos, note the location, time and what the infraction was, send it to us and we will post it.

Beaverton van not in compliance

For anyone who receives a ticket from Beaverton taken on 6/16/10 at 9800 SW Beaverton-Hillsdale Hwy.
You should know that the van was not in compliance with Oregon Statutes. They require that the signage be placed at a minimum of 100 yards.
Tonight the signage was placed at only 90 yards. If anyone needs picture evidence to present if they go to court, here you go.

Portland van not in compliance

Temporary Portland Van not in Compliance?

On Dec 9th at about 11 AM we happen to notice a van on NE Halsey that appeared to be a temporary photo radar van.  If this van was issuing tickets (which appeared to be doing with the flashes as vehicles passed by) wasn’t in compliance with ORS 810.439 (C) An indication of the actual speed of the vehicle is displayed within 150 feet of the location of the photo radar unit.

So, if you know anyone who received a ticket with the van not displaying the actual speed of the vehicles; you may get out of the ticket based on the city not obeying the Oregon Statutes. If you received a ticket, or know someone who did with this van, send us an e-mail.

Update about Milwaukie photo radar case

Well, the folks that showed up to court yesterday were told that their cases had been dismissed. We aren’t sure why, but the officer showed up and didn’t have the information in order to prosecute. So, we didn’t find out if they were actually issuing tickets out of the jurisdiction or not. Sorry we don’t have more information than that, we will see if we can get some more information. We do know that when Beaverton first started their program they were forced to refund a batch of tickets issued outside the city limits.

Milwaukie Photo Radar Ticketing Outside City Limits!?

It has been brought to our attention that on Sept 24th midday, the Milwaukie photo radar van was issuing citations outside the city limits (as far as we can tell from information and images provided). They were set up just north of the city limit line. See pictures and maps below. Tickets have been received as being in the 8600 Block of McLoughlin Blvd.
